(4) CardioNet: $2.5 Million Penalty for a Stolen Laptop In a HIPAA settlement with the Office for Civil Rights (OCR), CardioNet, a cardiac monitoring clinic, was fined $2.5 million. In January 2021, a laptop containing over 1300 patient medical records was stolen from an employee’s parked car near their Pennsylvania home.
The OCR found that the clinic had “insufficient risk analysis and risk management processes in place” when the laptop was stolen after conducting an investigation. CardioNet did not use encryption to protect electronic protected health information and did not have any policies in place to ensure the physical security of their mobile devices.
